 DENVER --  A 27-year-old man rounded up in a prostitution sting last week could face stiffer charges because he admitted to knowing that he had AIDS, the Denver District Attorney's Office said Wednesday.

 Darren Garcia was arrested last Thursday when he approached an undercover officer in a car and offered to provide oral sex.

 Garcia, who was posing as a woman, then told the officer on his way to jail that he has AIDS, District Attorney spokeswoman Lynn Kimbrough said.

 Whether or not Garcia has AIDS could not be disclosed, because the district attorney's office said they couldn't discuss his medical history.

 Prostitution is a violation of a city ordinance, and the person is issued city ticket. But prostitution with knowledge of AIDS or an HIV infection is a state felony charge punishable of up to three years in prison, Kimbrough said.

 Darren Garcia is being held in Denver jail in lieu of $50,000 bond. His mug shot shows him with long brown hair, wearing makeup and a Colorado Avalanche jersey.

 "That picture tells the whole story, doesn't it?" Kimbrough said.

 It's not known if Garcia has infected any people but because he solicited himself, knowing he could infect others, could result in a tougher penalty, Kimbrough said.

 Garcia has been arrested for prostitution five times before, according to court records. He pleaded guilty to prostitution in 2005, 2004, 2003 and 2002.

 In his most recent arrest, Garcia climbed into the car of an undercover officer at East Colfax Avenue and Josephine Street and offered to provide sex for $30.

 Colorado enacted a state law about a dozen years ago to make prostitution with knowledge of HIV or AIDS illegal, the Denver Post reported. The law was enacted to prevent a notorious Denver prostitute from spreading AIDS. She was eventually given a five-year prison sentence, the newspaper said.
